These Terms of Use ("Terms") apply to your use of affinityaisystems.com (the "website"), which is operated by AffinityAI (Pty) Ltd ("AffinityAI", "we", "us" or "our"). By using the website, you agree to these Terms. If you do not agree, please do not use the website.

Please read sections 5, 6 and 7 carefully. They limit our responsibility to you and are shown in bold for that reason.

AffinityAI (Pty) Ltd (registration number 2026/086116/07) is an enterprise AI consultancy based in Johannesburg, South Africa. "AffinityAI" is our trading name. You can contact us at info@affinityaisystems.com.

2. Using the website

You may use the website to learn about AffinityAI and our services and to contact us. You must not:

• use the website in any way that is unlawful or fraudulent, or that harms or could harm AffinityAI or anyone else;
• try to gain unauthorised access to, probe, scan or test the vulnerability of the website or the systems it runs on, or interfere with its operation, for example by introducing malware or overloading it;
• use bots, scrapers or other automated tools to copy content in bulk or to submit forms;
• submit false or misleading information, impersonate anyone, or send spam, advertising or harmful content through our forms; or
• copy, frame or republish the website or its content except as section 8 allows.

We may block access or take other appropriate action if we reasonably believe that these Terms have been breached.

3. Our services and pricing

The website describes our services in general terms. Service packages, features, timelines and other details on the website are indicative, are not an offer that can be accepted, and may change. We provide services only under a separate written proposal or agreement, which takes precedence over anything on the website. Contacting us or booking a consultation does not create a client relationship.

4. Information only, not professional advice

Content on the website, including blog articles, is general information about artificial intelligence and our services. It is not legal, financial, technical, regulatory or other professional advice, and you should not rely on it without advice about your specific circumstances.

5. No warranties

We provide the website "as is" and "as available". To the extent the law allows, we make no promise that the website will be available, uninterrupted, secure or free of errors or viruses, or that its content is complete, accurate or up to date. We may change, suspend or withdraw any part of the website without notice.

6. Limitation of liability

To the extent the law allows, AffinityAI is not liable for any loss or damage, whether direct, indirect, special or consequential, including loss of profit, revenue, data, business or goodwill. This applies to loss or damage arising from or connected with your use of, or inability to use, the website, your reliance on its content, or any third-party website or service linked from it, whether the claim is based on contract, delict (tort) or anything else. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any rights you have under the Consumer Protection Act 68 of 2008 where that Act applies.

7. Third-party websites and services

The website links to third-party websites and services, such as Calendly and LinkedIn, for your convenience. We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

8. Intellectual property

The website and its content, including text, graphics, the AffinityAI name and logo, design and software, belong to AffinityAI or its licensors and are protected by copyright, trade mark and other laws. Some design elements are used under licence. You may view the website and print or download extracts for your own information or internal business use, as long as you keep any copyright and other notices. You may not otherwise copy, modify, distribute, republish or commercially use any content without our prior written permission. Third-party names, logos and trade marks shown on the website belong to their owners, and showing them does not imply endorsement.

Our Privacy Policy explains how we handle personal information, including cookies.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. Subject to any rights you have under law that cannot be excluded, the South African courts have jurisdiction over any dispute about these Terms or the website.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. The version published when you use the website applies to that use.

12. General

If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect. If we do not enforce a right, that does not mean we have waived it. These Terms, together with our Privacy Policy, are the whole agreement about your use of the website. They do not replace any separate written agreement for our services.
